Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the CardioCapture mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and CardioCapture ("we," "our," or "us"). We may update these Terms from time to time, and your continued use of the App after any changes constitutes acceptance of the revised Terms.

2. Description of Service

CardioCapture is a mobile application that allows users to build, record, and manage workout data from gym cardio equipment. The App provides the following capabilities:

3. Subscriptions and Payment

CardioCapture offers a freemium model. Core features are available for free, while premium features require an active subscription.

Payment will be charged to your Apple ID account at confirmation of purchase. All payment processing is handled by Apple — CardioCapture does not directly collect, store, or process any payment information.

3.3 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

How to manage or cancel your subscription: Go to Settings > [Your Name] > Subscriptions on your Apple device, or manage your subscriptions through the App Store. You can cancel at any time — cancellation takes effect at the end of the current billing period, and you will retain access to premium features until then.

CardioCapture may offer free trial periods for premium features from time to time. If a free trial is offered:

Subscription prices may change from time to time. If we change the price of a subscription, Apple will notify you in advance. You will need to agree to the new price to continue your subscription. If you do not agree, your subscription will expire at the end of the current period.

4. Cancellation and Refunds

4.1 Cancellation

You may cancel your subscription at any time. To avoid being charged for the next billing period, you must cancel at least 24 hours before the end of the current period. After cancellation, you will continue to have access to premium features until the end of your current paid period.

4.2 Refunds

All purchases are made through the Apple App Store. Refund requests are handled by Apple in accordance with Apple's refund policies. CardioCapture cannot directly issue refunds for App Store transactions.

CardioCapture integrates with third-party services including Garmin Connect, Strava, TrainingPeaks, Coros, Apple Health, and Anthropic's Claude API. Your use of these services is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services. Your interactions with third-party services are solely between you and the third-party provider.

Important: When you connect CardioCapture to a third-party service, you authorize the transfer of data between CardioCapture and that service. You are responsible for reviewing and accepting the terms of any third-party service before connecting.

7. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, we do not warrant that:

You acknowledge that fitness data captured by the App is for informational purposes only and should not be relied upon for medical decisions. Always consult a qualified healthcare professional for medical advice.

8. Limitation of Liability

To the fullest extent permitted by applicable law, CardioCapture and its developers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the App.

This limitation of liability applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising from or relating to the App exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Third-Party Beneficiaries

Garmin

You acknowledge and agree that Garmin International, Inc. and its subsidiaries and affiliates are intended third-party beneficiaries of these Terms insofar as these Terms relate to your use of the Garmin Connect platform and data received from or sent to Garmin's services. Upon your acceptance of these Terms, Garmin shall have the right (and shall be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Apple

You acknowledge and agree that Apple Inc. and its subsidiaries are intended third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple shall have the right (and shall be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Note: Both Garmin and Apple have the right to enforce relevant provisions of these Terms directly against you, including the limitations of liability and disclaimers of warranties set forth herein.

10. Apple App Store Terms

The following terms apply to your use of the App as downloaded from the Apple App Store:

11. Intellectual Property

The App and its original content, features, and functionality are owned by CardioCapture and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Your workout data remains yours. We do not claim any ownership over the fitness data you create, import, or export through the App.

12. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to the App or other users.

Upon termination, all provisions of these Terms which by their nature should survive will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Ireland.

14. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle your information. By using the App, you consent to the practices described in our Privacy Policy.
