1. Acceptance of Terms

By downloading, installing, or using the CardioCapture mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and CardioCapture ("we," "our," or "us"). We may update these Terms from time to time, and your continued use of the App after any changes constitutes acceptance of the revised Terms.

2. Description of Service

CardioCapture is a mobile application that allows users to capture, record, and manage workout data from gym cardio equipment. The App provides the following capabilities:

• Capturing workout data from cardio equipment via your device's camera
• Storing workout data locally on your device
• Importing data from fitness wearables and platforms (e.g., Garmin Connect, Coros, Apple Health)
• Exporting workout data to training platforms (e.g., Strava, TrainingPeaks, Garmin Connect)
• An optional AI-powered workout builder that converts natural language descriptions into structured workout files
• Exporting workout data in standard file formats (FIT, TCX, GPX)

Some features of the App are available only with a paid subscription. See Section 3 for details.

3. Subscriptions and Payment

CardioCapture offers a freemium model. Core features are available for free, while premium features require an active subscription.

3.1 Subscription Plans

The following auto-renewable subscription options are available:

• Weekly Subscription: $0.99 per week
• Annual Subscription: $24.99 per year

3.2 Payment and Billing

Payment will be charged to your Apple ID account at confirmation of purchase. All payment processing is handled by Apple — CardioCapture does not directly collect, store, or process any payment information.

3.3 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

3.4 Free Trials

CardioCapture may offer free trial periods for premium features from time to time. If a free trial is offered:

• The trial duration and terms will be clearly stated before you subscribe
• Any unused portion of a free trial period will be forfeited when you purchase a subscription
• At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel at least 24 hours before the trial ends

3.5 Price Changes

Subscription prices may change from time to time. If we change the price of a subscription, Apple will notify you in advance. You will need to agree to the new price to continue your subscription. If you do not agree, your subscription will expire at the end of the current period.

4. Cancellation and Refunds

4.1 Cancellation

You may cancel your subscription at any time. To avoid being charged for the next billing period, you must cancel at least 24 hours before the end of the current period. After cancellation, you will continue to have access to premium features until the end of your current paid period.

4.2 Refunds

All purchases are made through the Apple App Store. Refund requests are handled by Apple in accordance with Apple's refund policies. CardioCapture cannot directly issue refunds for App Store transactions.

5. User Responsibilities

When using CardioCapture, you agree to:

• Use the App only for its intended purpose of recording and managing fitness data
• Not use the App in any manner that could damage, disable, or impair its functionality
• Comply with all applicable laws and regulations in your jurisdiction
• Not attempt to reverse-engineer, decompile, or disassemble the App
• Not use the App to upload or transmit any malicious content

6. Third-Party Services

CardioCapture integrates with third-party services including Garmin Connect, Strava, TrainingPeaks, Coros, Apple Health, and Anthropic's Claude API. Your use of these services is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services. Your interactions with third-party services are solely between you and the third-party provider.

7. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the foregoing, we do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Data received from third-party APIs, including the Garmin Connect API, will be accurate, complete, or available
• Any errors in the App will be corrected

You acknowledge that fitness data captured by the App is for informational purposes only and should not be relied upon for medical decisions. Always consult a qualified healthcare professional for medical advice.

8. Limitation of Liability

To the fullest extent permitted by applicable law, CardioCapture and its developers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the App.

This limitation of liability applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising from or relating to the App exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Third-Party Beneficiaries

Garmin

You acknowledge and agree that Garmin International, Inc. and its subsidiaries and affiliates are intended third-party beneficiaries of these Terms insofar as these Terms relate to your use of the Garmin Connect platform and data received from or sent to Garmin's services. Upon your acceptance of these Terms, Garmin shall have the right (and shall be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Apple

You acknowledge and agree that Apple Inc. and its subsidiaries are intended third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple shall have the right (and shall be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Apple App Store Terms

The following terms apply to your use of the App as downloaded from the Apple App Store:

• These Terms are between you and CardioCapture only, not with Apple. CardioCapture, not Apple, is solely responsible for the App and its content.
• Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• CardioCapture, not Apple, is responsible for providing any maintenance and support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
• CardioCapture, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including product liability claims, regulatory compliance claims, and consumer protection claims.
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, CardioCapture, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Intellectual Property

The App and its original content, features, and functionality are owned by CardioCapture and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Your workout data remains yours. We do not claim any ownership over the fitness data you create, import, or export through the App.

12. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to suspend or terminate your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to the App or other users.

Upon termination, all provisions of these Terms which by their nature should survive will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Ireland.

14. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle your information. By using the App, you consent to the practices described in our Privacy Policy.
